October 2013

People Resource Strategies' Principal, Lena Bodin, representing the Rockland Business Association (RBA), as the chair of its Small Business Council, as well as the New York State Society for HR Management (NYS SHRM), spoke on October 7, 2013, at the Senate Majority Coalition Hearing in Nanuet, NY, on the Wage Theft Prevention Act (WTPA). Ms. Bodin's testimonial was in support of repealing the annual notification requirement under the WTPA, a cumbersome and duplicative requirement under the Act of 2010.

Under the WTPA, employers are required to provide a specific DOL form to each new hire providing pay rate, hours of work, overtime rate, and other pertinent pay related information. In addition, an employer is also required to provide the same notice to each employee each calendar year in January. This results in an added burden for HR practitioners who are already busy at the beginning of each calendar year with other mandatory requirements as well as company requirements for their workforce.

The bipartisan Senate panel, where Ms. Bodin gave testimony, is focusing on improving the economic climate for small businesses in New York.

Repeal of the WTPA annual notification requirement is something Ms. Bodin, in her role as Legislative Co-Director, NYS SHRM, has been working on with her colleague, Susan Corcoran, Legislative Director, for two years now. They also are supported in this initiative with Legislative Directors from various chapters throughout the state, notably, the Long Island Chapter of SHRM.
